释义	有离婚协议的，遵协议中的约定分割。但要是没有离婚协议或协议不成的，如果在赠与时没有加说明或是赠与合同上只说给夫妻的，那么就算是夫妻的共同财产，双方均等分割。如果加有说明的那么这是个人财产，离婚时不分给对方。【本文关联的相关法律依据】《民法典》第一千零八十七条离婚时，夫妻的共同财产由双方协议处理；协议不成的，由人民法院根据财产的具体情况，按照照顾子女、女方和无过错方权益的原则判决。对夫或者妻在家庭土地承包经营中享有的权益等，应当依法予以保护。
