释义	我国的刑法规定，犯罪行为通常表现为以下的两种形式：作为和不作为。作为一般是指，犯罪人通过积极的行为来实施刑法禁止的对社会有危害的行为，也就是不应该这样做却这样做。不作为通常是指，犯罪人有实施的义务，并且有可能实施某种积极的行为，但是却没有实施的行为，也就是应该这样做却没有这样做。【本文关联的相关法律依据】《中华人民共和国刑法》第三条【罪刑法定】法律明文规定为犯罪行为的，依照法律定罪处刑；法律没有明文规定为犯罪行为的，不得定罪处刑。
