释义	法律分析: 串通拍卖的行为不构成犯罪，但在达成串通拍卖的过程中，可能构成其他犯罪。法律依据: 《中华人民共和国拍卖法》第三十七条竞买人之间、竞买人与拍卖人之间不得恶意串通，损害他人利益。第六十五条违反本法第三十七条的规定，竞买人之间、竞买人与拍卖人之间恶意串通，给他人造成损害的，拍卖无效，应当依法承担赔偿责任。由工商行政管理部门对参与恶意串通的竞买人处最高应价百分之十以上百分之三十以下的罚款；对参与恶意串通的拍卖人处最高应价百分之十以上百分之五十以下的罚款。
