释义	生产(包括配制)、销售劣药，涉嫌下列情形之一的，应予立案追诉：(一)造成人员轻伤、重伤或者死亡的;(二)其他对人体健康造成严重危害的情形。本条规定的"劣药"，是指依照《中华人民共和国药品管理法》的规定，药品成份的含量不符合国家药品标准的药品和按劣药论处的药品。法律依据《最高人民检察院、公安部关于公安机关管辖的刑事案件立案追诉标准的规定(一)》第十八条
