释义	法律分析：保证合同中保证方式未约定或者约定不明，应推定保证方式为一般保证。应注意的是，这一规定是民法典颠覆之前规定的做法之一。保证人以何种方式承担保证责任，一般在保证合同中明确约定。如果没有约定或约定不明确的，保证人应承担何种保证责任，这在长期的司法实践中，一直采取推定为保证人承担连带保证责任以保证债权的顺利实现。法律依据：《中华人民共和国民法典》第六百八十六条保证的方式包括一般保证和连带责任保证。当事人在保证合同中对保证方式没有约定或者约定不明确的，按照一般保证承担保证责任。
