释义	据最高人民法院《关于适用中华人民共和国民事诉讼法若干问题的意见》第12条规定，夫妻一方离开住所地超过一年，另一方起诉离婚的案件，由原告住所地人民法院管辖。夫妻双方离开住所地超过一年，一方起诉离婚的案件，由被告经常居住地人民法院管辖有经常居住地的，由原告起诉时居住地的人民法院管辖。以上所说的住所地，是指公民的户籍所在地经常居住地，是指公民离开住所地至起诉时已连续居住一年以上的地方，但公民住院就医的地方除外。
