释义	夫妻双方一方死亡债务的偿还问题需要参考借款的用途以及借款时间。对于不在共同债务之内的欠款，例如婚前一方所欠债务、一方个人的经济活动借款，此时一方死亡另一方则无需偿还。除此之外，对于婚前做了明确签约的条件，也不需要偿还一方的债务。但如果是夫妻共同债务，夫妻的任何一方都是有义务偿还的，一方去世，另一方要尽偿还义务。【法律依据】根据《关于审理民间借贷案件适用法律若干问题的规定》第二条，出借人向人民法院起诉时，应当提供借据、收据、欠条等债权凭证以及其他能够证明借贷法律关系存在的证据。
