银行欠款逾期多长才会提起起诉 |

一般来说，对于短期内的贷款逾期行为，贷款机构会视为非恶意逾期，只要贷款人马上将欠款全部偿还即可，不会再追究贷款人的责任，也不会上征信。不同的贷款机构对贷款逾期时间把握都不一样的。如银行，一般在贷款逾期三天内偿还欠款会视为贷款人非恶意逾期，而对于小额贷款公司这个时间就会更长，为了追回欠款往往一个星期之内都不会将逾期行为上征信。而对于长期逾期的行为，贷款机构就会将贷款逾期分类为恶意逾期，贷款被列为“坏账”，这个时候贷款机构会采取各种方式催缴欠款，如上门催收和到公司催收，甚至会将欠款人告上法庭。一般超过90天就会视为恶意逾期，超过120天就会采取法律手段。所以说一般贷款逾期超过120天，就很有可能被起诉。法律依据：《中华人民共和国民法典》第六百六十五条 【撤销赠与的法律后果】撤销权人撤销赠与的，可以向受赠人请求返还赠与的财产。《中华人民共和国民法典》第六百六十七条 【借款合同定义】借款合同是借款人向贷款人借款，到期返还借款并支付利息的合同。
