释义	法律分析: 合同诈骗的担保无效。被欺骗的情况下做担保人，担保没有效力。受欺诈方可以请求法院或者仲裁机构撤销该担保。担保行为在被撤销后自始无效，当事人因该行为所取得的财产要互相返还或则折价赔偿；并且过错方还要承担相应的责任。《中华人民共和国民法典》第一百四十八条一方以欺诈手段，使对方在违背真实意思的情况下实施的民事法律行为，受欺诈方有权请求人民法院或者仲裁机构予以撤销。
