2023年公司注销了员工还能仲裁吗 |

企业破产或关闭还是可以到当地劳动部门申请仲裁的, 如果劳动争议发生时，用人单位进入破产清算，那么劳动者仍可在仲裁时将其列为被申请人，清算组可以代表破产企业参加诉讼和仲裁活动。如果已经清算完毕，那么劳动者可以将接收清算资产的股东列为被申请人申请仲裁。我国法律会尽可能的保护每一个公民的权益都不受到损害，所以即使公司已经破产或者是注销，都是可以通过劳动仲裁来维护自己的权益的。
一、劳动仲裁需要的材料包括以下内容：
1、劳动争议仲裁申诉书；
2、身份证复印件；
3、被诉单位营业执照复印件或企业工商注册登记信息资料；
4、证据材料复印件；
5、当事人提交证据材料清单及证据说明。
二、劳动仲裁的步骤为：
1、争议发生后一年内申请仲裁，递交仲裁申诉书。
2、仲裁委员会收到申诉书之日起五日内作出是否受理的决定。
3、仲裁庭开庭五日前书面通知双方当事人。
4、开庭，明确请求，答辩，调查事实，举证质证，辩论，陈述。
5、调解。
6、调解不成，裁决。

第二条 中华人民共和国境内的用人单位与劳动者发生的下列劳动争议，适用本法：
（一）因确认劳动关系发生的争议；
（二）因订立、履行、变更、解除和终止劳动合同发生的争议；
（三）因除名、辞退和辞职、离职发生的争议；
（四）因工作时间、休息休假、社会保险、福利、培训以及劳动保护发生的争议；
（五因劳动报酬、工伤医疗费、经济补偿或者赔偿金等发生的争议；
（六）法律、法规规定的其他劳动争议。
第三条 解决劳动争议，应当根据事实，遵循合法、公正、及时、着重调解的原则，依法保护当事人的合法权益。
