释义	法律分析：广义上的劳务合同是包括承揽合同的，狭义上的劳务合同仅指雇佣合同雇佣合同与承揽合同的区别在于: 1、合同双方在从事劳务活动中的地位与关系者是支配和从属，后者是相互独立的；2、计酬依据和方式:前者计酬依据是劳务本身，后者依据则是劳动成果；3、对劳务提供者的亲历性要求不同。法律依据：《中华人民共和国民法典》第七百七十条承揽合同是承揽人按照定作人的要求完成工作，交付工作成果，定作人支付报酬的合同。承揽包括加工、定作、修理、复制、测试、检验等工作。
