释义	法律分析：债务人下落不明如果债务人有财产的，则能要回借款。债权人可以在债务人下落不明的两年后，向法院申请宣告其失踪，然后由其财产代管人以债务人的财产偿还债务。法律依据：《中华人民共和国民事诉讼法》第一百二十三条人民法院应当保障当事人依照法律规定享有的起诉权利。对符合本法第一百一十九条的起诉，必须受理。符合起诉条件的，应当在七日内立案，并通知当事人；不符合起诉条件的，应当在七日内作出裁定书，不予受理；原告对裁定不服的，可以提起上诉。
