释义	法律分析：不能，根据规定，如果空地两年内没有使用的，应当由县级以上人民政府收回土地使用权。法律依据：《确定土地所有权和使用权的若干规定》第二十九条因原房屋拆除、改建或自然坍塌等原因，已经变更了实际土地使用者的，经依法审核批准，可将土地使用权确定给实际土地使用者；空地及房屋坍塌或拆除后两年以上仍未恢复使用的土地，由当地县级以上人民政府收回土地使用权。
