释义	虽然精神损害的补救不同于物质损害的补救，但是精神损害予以赔偿的精神价值观符合辨证唯物主义，精神权利虽不能直接实现物化，但是一旦它被抽象为法律权利时，它可以借助法律技术的作用实现物化。这种物化，不是权利主体的物化，而只是权利客体的物化，也就是说，作为权利主体的“人”是不直接物化的，而“人”所享有的各种精神利益是可以物化的。这种法律技术上的拟制适用方法，虽然在实际上无法实现等价，但是由于对精神损害给予了某种替代物赔偿，使权利主体遭受的伤害在心理上和情感上得到平复和慰籍。
