释义	法律分析：公安机关侦查完毕，移送检察院审查起诉后，就进入了审查起诉阶段了。人民检察院审査后，认为主要犯罪事实已经查清，可能判处徒刑以上刑罚，采取取保候审、监视居住等方法尚不足以防止发生社会危险性，而有逮捕必要的，应当批准逮捕。法律依据：《中华人民共和国刑事诉讼法》第八十七条公安机关要求逮捕犯罪嫌疑人的时候，应当写出提请批准逮捕书，连同案卷材料、证据，一并移送同级人民检察院审查批准。必要的时候，人民检察院可以派人参加公安机关对于重大案件的讨论。
