释义	定金合同生效后，发生如下法律效力：(1)定金是主合同成立的证据，交付定金的书面证明可以证实主合同的存在。(2)定金合同生效后任何一方不得擅自变更或解除合同，除非使双方协商一致并达成书面协议。(3)定金于合同履行后，应当抵作价款或者收回。(4)当事人不履行合同时须承受定金罚则，既交付定金一方违反合同所付定金不予返还，收受定金的一方违反合同应双倍返还定金。
