释义	犯罪人自动投案，是自首成立的前提条件，没有这个前提，就谈不上自首。自动投案是指犯罪人在犯罪之后、归案之前，主动、直接向司法机关交代自己的犯罪事实，听候处理。自动投案包括三种基本情况：（1）在犯罪事实和犯罪人都没有被发现的情况下自动投案；（2）在犯罪事实已被发现但不知犯罪人是谁的情况下自动投案；（3）在犯罪事实和犯罪人都已经被发现而司法机关还没有采取强制措施的情况下自动投案。法律依据《中华人民共和国刑法》第六十七条
