释义	法律分析：挂靠经营关系的建筑施工企业以自己的名义或以被挂靠单位的名义签订的承包合同,一般应以挂靠经营者和被挂靠单位为共同诉讼人,起诉或应诉。挂靠当事人之间所订立的挂靠协议无效。被挂靠的施工企业与建设单位所订立的建筑安装工程承包合同无效。法律依据：《中华人民共和国建筑法》第二十六条禁止建筑施工企业超越本企业资质等级许可的业务范围或者以任何形式用其他建筑施工企业的名义承揽工程。
