释义	依据我国《刑法》第一百四十条规定，销售伪劣口罩构成犯罪的，涉嫌销售伪劣产品罪，可以处处十五年有期徒刑或者无期徒刑。生产者、销售者在产品中掺杂、掺假，以假充真，以次充好或者以不合格产品冒充合格产品，涉嫌下列情形之一的，应予立案追诉： 1、伪劣产品销售金额五万元以上的; 2、伪劣产品尚未销售，货值金额十五万元以上的; 3、伪劣产品销售金额不满五万元，但将已销售金额乘以三倍后，与尚未销售的伪劣产品货值金额合计十五万元以上的。法律依据《刑法》第一百四十条
