释义	《刑法》第二十四条规定：在犯罪过程中，自动放弃犯罪或者自动有效地防止犯罪结果发生的，是犯罪中止。对于中止犯，没有造成损害的，应当免除处罚；造成损害的，应当减轻处罚。犯罪中止但实际已造成了损害，应当理解为造成了一定的法益侵害结果（构成某种轻罪的既遂犯），但没有造成行为人原本希望或者放任的犯罪结果。比如：强奸犯以暴力实施猥亵行为后，自动中止强奸行为的，其先前行为已经侵害了妇女的性自主权（强制猥亵既遂），属于造成了损害，如以强奸罪追究刑事责任，则应当减轻处罚，但不能免除处罚。
