行政拘捕案底可以找人消了嘛 |
| 释义 |
行政拘捕的记录是不会消除的，会一直留存在公安系统中。人事档案只留犯罪记录，行政拘捕不属于刑事犯罪，所以，不会记录在人事档案中。但是，行政拘捕属于违法，个人会有违法犯罪记录，在公安系统可以查到。法律对它的设定及实施条件和程序均有严格的规章
法律依据:
《中华人民共和国刑事诉讼法》 第二百八十六条 犯罪的时候不满十八周岁，被判处五年有期徒刑以下刑罚的，应当对相关犯罪记录予以封存。
犯罪记录被封存的，不得向任何单位和个人提供，但司法机关为办案需要或者有关单位根据国家规章进行查询的除外。依法进行查询的单位，应当对被封存的犯罪记录的情况予以保密。
最高人民法院 最高人民检察院公安部 国家安全部 司法部《关于建立犯罪人员犯罪记录制度的意见》 犯罪记录是国家专门机关对犯罪人员情况的客观记载。犯罪记录制度是现代社会管理制度中的一项重要内容。为适应新时期经济社会发展的需要，进一步推进社会管理创新，维护社会稳定，促进社会和谐，现就建立我国犯罪人员犯罪记录制度提出如下意见。
