释义	侵权责任是指民事主体因实施侵权行为而应承担的民事法律后果。侵权责任是任何人都对他人承担这样一种义务；即不因为自己的错误（过错）行为而侵害了他人的合法权益，否则即能构成侵权行为，要对受害方承担责任。侵权行为基本上都是违法行为。法律依据《民法典》第一千一百六十五条，行为人因过错侵害他人民事权益造成损害的，应当承担侵权责任。依照法律规定推定行为人有过错，其不能证明自己没有过错的，应当承担侵权责任。
