释义
作出放弃继承遗产的声明是不能任意撤销的，根据《最高人民法院关于贯彻执行《中华人民共和国继承法》若干问题的意见》第50条之规定：遗产处理前或在诉讼进行中，继承人对放弃继承反悔的，由人民法院根据其提出的具体理由，决定是否承认。遗产处理后，继承人对放弃继承反悔的，不予承认。所以如继承人在放弃继承后反悔，首先可以于其他继承人协商，如其他继承人一直同意其撤销放弃继承声明，则可以仍按原各自份额继承。如不能协商一致则需经人民法院根据具体理由决定是否同意其撤销放弃继承声明。
