释义	法律分析：出现劳动合同到期但劳资双方未终止劳动关系的情形后，劳动合同到期后，用人单位应当在一个月内与劳动者续订书面劳动合同。用人单位无正当理由超过一个月未与劳动者订立书面劳动合同，自满一个月的次日起，应当向劳动者每月支付双倍的工资。法律依据：《关于审理劳动争议案件适用法律若干问题的解释》第十六条劳动合同期满后，劳动者仍在原用人单位工作，原用人单位未表示异议的，视为双方同意以原条件继续履行劳动合同。
