释义	法律分析：有下列规定：一、中级人民法院判处死刑缓期二年执行的第一审案件，被告人不上诉、人民检察院不抗诉的，应当报请高级人民法院核准。二、高级人民法院对于报请核准的死刑缓期二年执行的案件，按照下列情形分别处理：1、同意判处死刑缓期二年执行的，应当裁定予以核准；2、认为原判事实不清、证据不足的，应当裁定发回重新审判；3、认为原判量刑过重的，应当依法改判。法律依据：《刑法》第248条，中级人民法院判处死刑缓期二年执行的案件，由高级人民法院核准。
