释义	一、业主交了定金甲方要退房违约的一方需要赔偿对方违约金的。二、按照《合同法》规定，交易双方，收定金的一方违约的，交定金的一方可以要求双倍返还；交定金的一方违约的，收定金的一方可以不返还定金。如果起诉对方承担定金的双倍退还责任，法庭将会予以支持。三、依据《担保法》第89条规定，当事人可以约定一方向对方给付定金作为债务的担保。债务人履行债务后，定金应抵作价款或者收回。给付定金的一方不履行约定的债务的,无权要求返还定金收受定金的一方不履行约定的债务的，应双倍返还定金。
