释义	法律分析: 依据最高人民法院的规定，个人并不是属于法人组织，所以个人是不具有破产主体资格的，不能申请破产。法律依据: 《最高人民法院〈关于审理企业破产案件若干问题的规定〉》第四条申请(被申请)破产的债务人应当具备法人资格，不具备法人资格的企业、个体工商户、合伙组织、农村承包经营户不具备破产主体资格。第五条国有企业向人民法院申请破产时，应当提交其上级主管部门同意其破产的文件他企业应当提供其开办人或者股东会议决定企业破产的文件。
