释义	夫妻共同债务共同清偿的例外情形： 1、夫妻一方在从事赌博、吸毒等违法犯罪活动中所负债务，第三人主张该债务为夫妻共同债务，要求债务人的配偶对其承担连带偿还责任的，人民法院不予支持。 2、夫妻一方与第三人串通，虚构债务，第三人主张该债务为夫妻共同债务，要求双方共同清偿的，人民法院不予支持。法律依据: 《中华人民共和国民法典》第一千零八十九条离婚时，夫妻共同债务应当共同偿还。共同财产不足清偿或者财产归各自所有的，由双方协议清偿；协议不成的，由人民法院判决。
