一、嫖娼是违法还是犯罪
嫖娼是违法行为。嫖娼的处罚标准：
1、卖淫、嫖娼的，处十日以上十五日以下拘留，可以并处五千元以下罚款；
2、情节较轻的，处五日以下拘留或者五百元以下罚款；
3、在公共场所拉客招嫖的，处五日以下拘留或者五百元以下罚款。
嫖娼是指不特定的同性之间或者异性之间以金钱、财物为媒介发生性关系的行为。
二、嫖娼的量刑标准是什么
我国刑法没有规定嫖娼罪这一罪名，也就是说，嫖娼不构成犯罪。但嫖娼会面临治安处罚，其处罚标准如下：处十日以上十五日以下拘留，可以并处五千元以下罚款。嫖娼是指二人及二人以上，以金钱、财物为媒介，发生不正当性关系的行为。即非法的性交易，建立于金钱交易上的性关系。根据《治安管理处罚法》第六十六条规定，卖淫、嫖娼的，处十日以上十五日以下拘留，可以并处五千元以下罚款；情节较轻的，处五日以下拘留或者五百元以下罚款。在公共场所拉客招嫖的，处五日以下拘留或者五百元以下罚款。
三、因此嫖娼一般要被关几天
对于嫖娼惩罚，一般情况下，嫖娼属于违法行为，公安机关对卖淫嫖娼人员实施处罚，必须与违法行为的事实、性质、情节以及社会危害程度相当，卖淫、嫖娼的，处十日以上十五日以下拘留，可以并处五千元以下罚款;情节较轻的，处五日以下拘留或者五百元以下罚款。在公共场所拉客招嫖的，处五日以下拘留或者五百元以下罚款。
