释义	法律分析：现行法律规定，企业同员工未签订劳动合同但存在劳动关系的，作为事实劳动关系，仍受法律保护，而作为事实劳动关系，企业要终止必须提前30天通知员工并应依法补偿；法律还规定，只签订试用期合同的，试用期不成立，该试用期即为劳动合同期限。显然，试用期内不签劳动合同或只签试用期合同，此种做法不可取，正确做法应是同新进员工签订劳动合同，劳动合同中包含试用期的内容。法律依据：《劳动法》第二十一条，劳动合同可以约定试用期。试用期最长不得超过六个月。
