问题	有抵押的债权是破产债权吗
释义	有抵押的债权不属于破产债权。破产债权不同于别除权，有担保的债权人行使的是别除权。别除权突破了破产法上债权集体受偿原则，其实质是一种个别清偿，所以有抵押的债权不属于破产债权。法律依据《企业破产法》第一百零九条，对破产人的特定财产享有担保权的权利人，对该特定财产享有优先受偿的权利。
