释义	先履行债务的一方不先履行不一定要承担违约责任。应当先履行债务的当事人，有确切证据证明对方有下列情形之一的，可以中止履行，此时不先履行不需要承担违约责任： 1.经营状况严重恶化； 2.转移财产、抽逃资金，以逃避债务； 3.丧失商业信誉； 4.有丧失或者可能丧失履行债务能力的其他情形。【本文关联的相关法律依据】《中华人民共和国民法典》第五百七十七条当事人一方不履行合同义务或者履行合同义务不符合约定的，应当承担继续履行、采取补救措施或者赔偿损失等违约责任。
