如何看待交通肇事犯罪案中的自首问题 |

一种观念认为：对交通肇事犯罪案中的自首问题，应根据不同的情况确定为自首。对肇事者事发后没有逃逸主动向公安机关报告的，如上述第一种观点所说，不应认定为自首，但在处理时应酌情从轻;对肇事后逃逸，在公安机关侦查阶段自动到公安机关投案，如实供述自己罪行的，则应视为自首。对后者，《刑法》第六十七条虽规定对其可以从轻或者减轻处罚，但在量刑的掌握上，从轻或减轻的幅度应比前者小。
第二种观点认为：在交通肇事案件中，肇事者在事发后主动报告公安机关，是其法定义务的义务。国务院颁发的《道路交通事故处理办法》第七条规定，发生交通事故后，肇事者必须报告公安机关或执勤的交通警察，听候处理。鉴于法规对其具有特定身份的交通肇事者赋予了强制性告知义务，因此即使肇事者在事故发生后没有逃逸，主动向公案机关报案或者主动到公安机关投案，也不能认定为自首，只能视为肇事者履行了告知义务，在处罚时可作为认罪态度较好的情节予以考虑，给予从轻处罚。
第三种观点认为：交通肇事犯罪案件中，肇事者在事发后没有逃逸，保护现场，抢救伤者和财产，主动向公案机关报案或自动投案，并如实供述自己的罪行的，应依法认定为自首;肇事者逃逸后在公案机关，侦查期限间，又主动到公案机关报案并如实供述自己罪行的，依法也应认定为自首。
