释义	法律分析：夫妻双方签订的离婚财产分割协议中对不动产权属的约定不直接产生物权变动的效力，夫妻一方仅可基于债权请求权向夫妻另一方主张履行不动产物权变更登记的契约义务。在不动产产权人未依法变更的情况下，离婚财产分割协议中关于不动产权属的约定不具有对抗第三人债权的效力法律依据：《中华人民共和国民法典》第二百零九条不动产物权的设立、变更、转让和消灭，经依法登记，发生效力;未经登记，不发生效力，但法律另有规定的除外。”对物权的变动，不能仅以是否登记作为要件，而要更多地尊重当事人的意思自治。
