释义	房屋买卖中的定金能否退要视情况而定。1、如果卖方收了定金后不履行合同，比如不卖房的，定金应双倍退回。2、如果给付定金的买方不履行合同，比如因自己的原因不想购房了，则不能要求退定金。依据我国相关法律的规定，债务人履行债务的，定金应当抵作价款或者收回。给付定金的一方不履行债务或者履行债务不符合约定，致使不能实现合同目的的，无权请求返还定金;收受定金的一方不履行债务或者履行债务不符合约定，致使不能实现合同目的的，应当双倍返还定金。法律依据《中华人民共和国民法典》第五百八十七条
