释义	法律分析：(1)当事人仅以一方违反夫妻忠实义务等为由而提起诉讼的，人民法院不予受理;已经受理的，裁定驳回起诉。(2)当事人依法律规定向法院申请宣告婚姻无效的，申请时法定的无效情形已经消失的，应不予支持。(3)夫妻一方或双方死亡1年内，生存一方或利害关系人依法律规定申请宣告婚姻无效的，应受理。法律依据：《中华人民共和国民法典》第一千零五十一条有下列情形之一的，婚姻无效：(一)重婚;(二)有禁止结婚的亲属关系;(三)未到法定婚龄。
