释义	出租的房屋发生火灾的，房东有没有责任主要看房东是否尽的消防的责任，以及火灾的原因而定，如果不确定原因的，可以进行调查。公安机关消防机构有权根据需要封闭火灾现场，负责调查火灾原因，统计火灾损失。火灾扑灭后，发生火灾的单位和相关人员应当按照公安机关消防机构的要求保护现场，接受事故调查，如实提供与火灾有关的情况。公安机关消防机构根据火灾现场勘验、调查情况和有关的检验、鉴定意见，及时制作火灾事故认定书，作为处理火灾事故的证据。法律依据《中华人民共和国消防法》第五十一条
