问题	临时工要怎样做工伤鉴定
释义	【法律意见】临时工和正式工一样申请劳动能力鉴定，首先先申请工伤认定，单位申请必须在发生工伤起1个月内，个人单位必须在发生工伤起1年内提出申请。出院前已作出工伤认定的，用人单位、工伤职工或者其直系亲属应当在职工医疗终结期满三十日内向本当地劳动能力鉴定委员会提出申请，并提供工伤认定决定和职工工伤医疗的有关资料。医疗终结期需延长的，由劳动能力鉴定委员会批准。医疗终结期按国家和省市有关规定执行。出院后作出工伤认定的，应当在作出工伤认定后三十日内提出劳动能力鉴定申请并按规定进行鉴定。
