离婚夫妻共同债务怎么偿还 |

具体情况分为三种：
(一)双方的共同财产足以清偿共同债务的，以共同财产来清偿共同债务，剩余财产在双方之间平等分配；
(二)共同财产不足以清偿共同债务的，由双方协议清偿，如协议不成，由法院进行判决；
(三)
不存在共同财产的情况下，债务由双方协议清偿，如协议不成，仍由法院进行判决；如果夫或妻一方死亡的，生存一方应当对婚姻关系存续期间的共同债务承担清偿责任。
一、哪些属于夫妻共同债务？
夫妻离婚涉及到债务问题，首先要理清哪些是夫妻共同债务，哪些是夫妻个人债务。在相关法律法规上的规定中，离婚夫妻共同债务，其表现形式有：
(一)夫妻共同所经手的债务，或一方经手所借但确是用于家庭开支的债务；
(二)个人债务，其表现形式为一方借债是为了用于个人目的，而另一方不知道，或虽知道但予以反对的，如借债用于个人赠与或吸毒、赌博、个人挥霍等等；
(三)个人债务转化为共同债务的，即婚前一方借款购置的房屋财物已转化为夫妻共同财产的，为购置借款所负债务。
实践中，只有先对哪些属于夫妻共同债务进行认定后，才能对偿还问题作出解决。通常时候，对夫妻共同债务是由夫妻共同财产来偿还的，共同财产不足以偿还债务的由双方协议偿还，无法达成协议的，则有法院进行判决。偿还夫妻共同债务是双方的事情，并不是全部由一方承担，当然也不排除双方约定由一方来清偿。
