释义	法律分析：我国对于缓刑刑期起止的规定为缓刑考验期限从判决确定之日起计算。判决执行之日前已经被先行羁押，应以被告人实际被羁押之日作为其刑期的起算日，然后根据所判刑期确定其刑期的终止日期；没有被先行羁押的，应以判决宣判之日作为其刑期的起算日，然后根据所判刑期确定其刑期的终止日期。法律依据《中华人民共和国刑法》第七十三条拘役的缓刑考验期限为原判刑期以上一年以下，但是不能少于二个月。有期徒刑的缓刑考验期限为原判刑期以上五年以下，但是不能少于一年。缓刑考验期限，从判决确定之日起计算。
