释义	债务人确实无力偿还债务的，可以和债权人协商延期或者分期偿还。债权人起诉到法院判决后，债务人有能力执行法院判决而拒不执行的，会被拘留、罚款。情况严重的构成拒不执行判决罪。当然，债务人确实没有能力偿还的，不会被追究刑事责任。法律依据：《民法通则》第一百零八条规定：债务应当清偿。暂时无力偿还的，经债权人同意或者人民法院裁决，可以由债务人分期偿还。有能力偿还拒不偿还的，由人民法院判决强制偿还。
