释义	免费乘车出事故，驾驶员该负责任。但如果驾驶员在交通事故中没有重大过错或者故意的，同乘者因交通事故受伤或者财产损失的，可以减轻驾驶员赔偿责任，如果存在故意或者过错的，应当酌情赔偿受害者损失。【法律依据】《中华人民共和国民法典》第八百二十三条承运人应当对运输过程中旅客的伤亡承担赔偿责任；但是，伤亡是旅客自身健康原因造成的或者承运人证明伤亡是旅客故意、重大过失造成的除外。前款规定适用于按照规定免票、持优待票或者经承运人许可搭乘的无票旅客。
