释义
未支付违约金的违约责任：当事人一方未支付价款或者报酬的，对方可以要求其支付价款或者报酬。1、付不起违约金属于民事案件，不会坐牢；2、只有在有能力而拒不执行的情况下，才涉嫌拒不执行判决、裁定罪，要坐牢。

《刑法》
第三百一十三条 对人民法院的判决、裁定有能力执行而拒不执行，情节严重的，处三年以下有期徒刑、拘役或者罚金。
