释义	法律分析：不一样。工伤退休人员待遇和退休人员工资待遇不一样，按人身损害赔偿。退休人员不具有法定劳动者资格，用工单位聘用的，不是劳动关系，不受劳动法规调整，不适用《工伤保险条例》，不能申请工伤认定。工作中遭受事故伤害的，由雇佣单位按人身损害承担赔偿责任，但本人具有过错的，可以减轻赔偿责任。法律依据：《关于审理劳动争议案件适用法律若干问题的解释（三）》第七条用人单位与其招用的已经依法享受养老保险待遇或领取退休金的人员发生用工争议，向人民法院提起诉讼的，人民法院应当按劳务关系处理。
