宅基地户主去世怎么办
释义
如果宅基地房屋继承人是本集体经济组织成员,符合宅基地申请条件的,可以申请取得该宅基地；如果不符合申请条件,则可以将房屋卖给本村其他符合申请条件的村民,由该村民申请获得该宅基地。
不愿出卖,该房屋不得翻建、改建、扩建,待处于不可居住状态时,宅基地由集体经济组织收回。
法律依据
《中华人民共和国土地管理法》第八条
城市市区的土地属于国家所有。农村和城市郊区的土地,除由法律规定属于囯家所有的以外,属于农民集体所有;宅基地和自留地、自留山属于农民集体所有。
