释义	法律分析：父母死亡后土地的使用权和经营权只要还在承包期内，就仍然归其子女所有，村集体不会收回。如果父母拥有多名子女，但是去世前没有立下遗嘱，那么土地确权就由其所有子女平等地继承。在继承时子女们可以自己商量选择平均或者不平均地割分土地的使用权和经营权。但土地的所有权仍然国家和集体所有。法律依据：《中华人民共和国民法典》第一千一百二十二条遗产是自然人死亡时遗留的个人合法财产。依照法律规定或者根据其性质不得继承的遗产，不得继承。
