问题	未注册商标应遵循哪些规定
释义	我国商标大部分实行自愿申请注册原则，未注册的商标可以正常使用，但不得冒充注册商标使用，也不得违反商标法第十条规定的禁用型条款。否则违法经营额五万以上的，可以处违法经营额百分之20以下的罚款。没有违法经营额或者违法经营额不足五万的，可以处1万以下的罚款。对于国家规定必须使用注册商标的商品，必须申请注册商标。未经核准注册的不得在市场上销售，这里指的必须使用注册商标的商品包括药品烟草制品。法律依据:《商标法》第10条，第48条，第52条《中华人民共和国商标法》第五十七条
