法律分析：申请商标的资格和条件有：
1、我国商标注册申请人必须是依法设立的企事业单位、社会团体、个体工商户和个人合伙企业；
2、申请注册的商标应当具备下列条件：
（1）申请注册的商标必须具有法定要素，即必须是文字、图形或其组合，否则不能作为商标使用；
（2）商标使用的文字、图形或其组合应具有显著的特征，便于识别。
法律依据：《中华人民共和国商标法》
第二条 国务院工商行政管理部门商标局主管全国商标注册和管理的工作。
国务院工商行政管理部门设立商标评审委员会，负责处理商标争议事宜。
