家长离婚，孩子可以自己选择跟谁吗 |

家长离婚，孩子满8周岁的，能选择跟谁生活。
8周岁以上的孩子是限制民事行为能力人，可以独立进行相应的民事行为，即有权利表达自己的意愿，可以选择随父或随母亲生活。
随着成长环境的改善、教育的普及和信息社会的发展，8周岁以上的孩子基本能够感知父母与自己情感上的亲疏远近，对于父母离婚后，自己与谁共同生活能够得到更多关爱、更稳定的生活和教育环境，已有一定的判断能力，其意见值得参考。
另外，法律选择尊重孩子的选择，让其在涉及自己切身利益的问题上拥有发言权，也是一种法治的进步。但是这并不意味着已满8周岁的未成年子女的意见就是唯一判定标准，还得结合其他情形综合考量。
【法律依据】
《民法典》第一千零八十四条，父母与子女间的关系，不因父母离婚而消除。离婚后，子女无论由父或者母直接抚养，仍是父母双方的子女。
离婚后，父母对于子女仍有抚养、教育、保护的权利和义务。离婚后，不满两周岁的子女，以由母亲直接抚养为原则。
已满两周岁的子女，父母双方对抚养问题协议不成的，由人民法院根据双方的具体情况，按照最有利于未成年子女的原则判决。子女已满八周岁的，应当尊重其真实意愿。
