释义	代孕合同属于明显违背社会公序良俗的约定，往往涉及给付财物的条款义务，不具有合法性，即使代孕合同具备一般合同的生效要件，也不具有合法性。我国法律虽未明确规定禁止代孕，但是实践中代孕是有善良风俗、道德风尚，不被社会接受的。法律依据《中华人民共和国民法典》第一百五十三条【违反强制性规定及违背公序良俗的民事法律行为的效力】违反法律、行政法规的强制性规定的民事法律行为无效。但是，该强制性规定不导致该民事法律行为无效的除外。违背公序良俗的民事法律行为无效。
